Refusal and Appeals

Canada Immigration and Refugee Board of Canada has separate division called IAD(Immigration Appeal Division) which hears appeals on immigration related matters.
Here are some of the situations where you can make a appeal for the current immigration decision you have received.

  • You have sponsored a family member and their application for permanent residence was refused.
  • You have received a removal order.
  • You have applied for permanent resident travel document at overseas visa offices and the application was refused.
  • You have received a decision allowing you to stay In Canada, but ministry has appeared that decision.

There are separate divisions in IRB responsible for different immigration or refugee matters. The procedure is more like administrative court committee but less formal and is flexible. The process is based on Canadian laws, Canada’s international obligations and Canada’s humanitarian tradition which may involve many forms and other paperwork to make it more efficient and fairer.
