Refugees and Asylum

Canada provides refugee to people who are in needs of protections. There are multiple programs that have refugees settle in Canada. The reason you are seeking asylum for should be legitimate and your application will be rejected, and you will not receive refuge.

Individuals can make a refugee claim upon arrival at a port of entry or online if they are already in Canada and in not subject to removal order. If you are Outside Canada, you may be eligible to resettle in Canada as refugee or immigrate to Canada through one of the programs. Contact us to know more.

The asylum-seeking claim will be validated through a strict process according to Canadian and international laws to check its legitimacy. When you make refugee claim your application is referred to IRB (Immigration and Refugee Board of Canada) which is a independent committee to determine if an individual is eligibility.

The IRB decides who is a Convention refugee or a person in need of protection.

Convention refugees are outside their home country or the country they normally live in. They’re not able to return because of a well-founded fear of persecution based on

  • race
  • religion
  • political opinion
  • nationality
  • being part of a social group, such as women or people of a particular sexual orientation

A person in need of protection is a person in Canada who can’t return to their home country safely. This is because, if they return, they may face

  • danger of torture
  • risk to their life
  • risk of cruel and unusual treatment or punishment

Also Canada has a safe third country agreement with US which state that people must make refugee claim in first safe country they arrive in. Which means you cannot make refugee claim if you enter Canada through US. But there are some expectations such as if you have family in Canada.
